Terms and Conditions

These terms and conditions apply to all entrants to Sea Shepherd Conservation Society’s (SSCS) video competition (Competition).  By contributing audio and/or video content, imagery, information, and/or other materials to this Competition, entrants signify their agreement to the following terms and conditions.  If you do not agree to all of these terms and conditions, please do not enter this Competition.  Only entries complying with contest rules, restrictions, terms, and conditions are eligible to win.

Rules and Restrictions

  1. Competition Dates: The Competition will begin on September 20, 2010.  All submissions are due no later than 5:00 pm on Sunday, October 31, 2010 (Pacific Daylight Time).
  2. Eligibility: Entrants must be 18 years or older and a member of Sea Shepherd at the time of entry.
  3. How to Enter: No entry fee. To enter the contest, visit Captain Watson’s “YouTube Your Way to becoming a Whale Warrior” video on YouTube (link can be found at our homepage at seashepherd.org) and post a video response. For more information on how to “post a video response” please visit YouTube’s help page as we cannot and will not be responsible for any technical issues relating to YouTube: http://www.google.com/support/youtube/bin/answer.py?hl=en&answer=57931 Entrant must be the creator of the video and he or she must own all rights to the video.  Incomplete, untrue, or misleading entry forms will be grounds for disqualification and removal of your video.
  4. Number of Entrants: Videos may feature an individual or a group, but for contact and other purposes, each video must specify only one entrant.  Sea Shepherd has room for only one crew member to join the campaign via this competition and will not be able to accommodate multiple entrants from a winning video, so failure to designate one entrant per video will result in disqualification.
  5. Number of Submissions: Entrants may submit an unlimited number of videos, provided each video demonstrates a separate and original idea.
  6. Video Details: The video must be original and may not have been previously submitted to or won another video contest.
  7. Length: Maximum video length is 2 minutes.  Videos longer than 2 minutes will not be considered for the Competition or included in the judging rounds.
  8. Content: Videos containing profanity, nudity, violence, and/or racist or sexist remarks or sentiments are strictly prohibited and will be disqualified. Video must be in English.
  9. Judging Process: The videos will be judged by a panel of Sea Shepherd staff and crew members, led by Captain Paul Watson. The decisions of the judges are final and binding.  The initial round of judging will be based entirely on the creativity, originality, and quality of the videos submitted.  This is not a competition of chance; rather, it is based on skill.  After the initial round of judging has been completed, the top five finalists will be notified and asked to complete a Sea Shepherd crew member application form.  Each finalist then will go through Sea Shepherd’s standard crew member interview process prior to a final decision by the judges.
  10. Notification: Due to the number of submissions, entrants who do not progress to the Competition’s final rounds will not be notified.  Winning entrants will be contacted at the conclusion of each judging cycle, beginning on Sunday October 31, 2010. The final winner will be notified and publically announced on Monday November 8, 2010.
  11. Prizes:

1st Prize: The winner, after completing the required application process, will be given the opportunity to crew on board a Sea Shepherd vessel during an official Sea Shepherd campaign – Operation No Compromise, an expedition to the waters of the Antarctic Ocean – from approximately December 2010 - February 2011. The winner may not transfer prize rights or obtain substitutions.  If the winner cannot be contacted, is disqualified, or is accepted but unable to join the campaign, he or she will forfeit the opportunity to do so.  Sea Shepherd will then consider, in its sole discretion, whether to offer this option to a runner-up, assuming that such runner-up successfully clears the required screening process outlined above.  While it is SSCS’s intention to accept the winning entrant as a crew member, SSCS ultimately reserves the right to accept a crew member only if it is able to find the right fit.
2nd Prize: $300 gift certificate in the regional e-Store closest to 2nd runner up.
3rd Prize: $200 gift certificate in the regional e-Store closest to 3rd runner up.

  1. Winner Responsibilities and Obligations: If selected, the winner is fully responsible for his or her own travel expenses to and from the vessel and any other personal costs associated with serving as a crew member on board a SSCS campaign.  The winner must complete all required agreements, including but not limited to a Crew Application Form, Confidentiality Agreement, Media Release, Appearance Release, Volunteer Waiver of Liability, etc. before being permitted on board any vessel.  The winner must comply at all times with SSCS rules and regulations and follow the chain of command on board the vessels, or he or she may be asked to leave without any notice. 
  2. Crew Application: All other terms and conditions as stated on the SSCS Crew Application Form will apply at all times.  These are subject to change at any time, with or without notice to the entrant, and at SSCS’s sole discretion. 
  3. Disqualification: By participating in the Competition, each entrant agrees to be bound by the official contest rules and the decisions of the judges.  Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means may be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  SSCS will interpret these rules and resolve any disputes, conflicting claims, or ambiguities concerning the rules or the contest, and its decisions concerning such disputes shall be final.  If the conduct or outcome of the contest is affected by human error, mechanical malfunctions or failures of any kind, intentional interference, or any event beyond SSCS’s control, SSCS reserves the right to terminate the Competition or make such other decisions regarding the outcome as it deems appropriate.  SSCS may waive any of these rules in its sole discretion. 
  4. Publicity/Use of Personal Information: By participating, where allowed by law, all entrants grant SSCS exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other competitions and waive any claims to royalty, right, or remuneration for such use.  By participating in the Competition, where allowed by law, participants agree that Sea Shepherd may disclose personal information obtained from participants in the Competition to third parties and use such information for marketing and other purposes. 

Submissions and Conduct

The following terms and conditions apply to all audio, video, and/or textual content entrants may submit to SSCS:

  1. SSCS does not endorse any submission or any opinion, recommendation, or advice expressed therein, and SSCS expressly disclaims any and all liability in connection with submissions.
  2. Entrants are obligated to abide by all applicable federal, state, and local laws, including, but not limited to, those pertaining to such areas as libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, intellectual property, and copyright or trademark infringement.
  3. Entrants shall be solely responsible for their own submissions and the consequences of posting or publishing them.  SSCS has no obligation to, and does not in the normal course of business, monitor or control any information that is or becomes available on the YouTube site.
  4. SSCS does not permit infringement of any intellectual property rights and will disqualify any submission if properly notified that its contents infringe on another’s intellectual property rights.  In connection with submissions, entrants affirm, represent, and/or warrant that they own or have the necessary licenses, rights, consents, and permissions to use and authorize SSCS to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all submissions to enable inclusion and use of the submissions in the manner contemplated by SSCS and these Terms and Conditions.
  5. By submitting a video to SSCS for this Competition, each entrant hereby grants SSCS a worldwide, non-exclusive, royalty-free, sublicenseable, and transferable license to use, reproduce, distribute, display, perform, and prepare derivative works of the submissions in connection with the SSCS website and organization, including and without limitation, for promoting and redistributing part or all of the SSCS website (and derivative works thereof) in any media formats and through any media channels.  
  6. Entrants further agree that they will not submit material that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Sea Shepherd all of the license rights granted herein.

Release and Indemnity

By participating in the contest, each entrant waives any and all claims of liability against SSCS and its employees and agents for any personal injury or loss which may occur from the conduct of or participation in the contest or from the use of any prize.  SSCS is not responsible for the accuracy, usefulness, safety, or intellectual property rights relating to videos submitted to this competition.  Entrants may be exposed to submissions that are inaccurate, offensive, indecent, or objectionable, and entrants agree to waive, and hereby do waive, any legal or equitable rights or remedies they have or may have against SSCS with respect thereto, and agree to indemnify and hold SSCS, its owners/operators, affiliates, and/or licensors harmless to the fullest extent allowed by law regarding all matters related to entrants’ participation in this Competition.
